A sessions court in Srinagar on Tuesday stayed a magistrate’s order directing the registration of a criminal case against Senior Superintendent of Police (SSP) Srinagar G V Sundeep Chakravarthy, saying the officer’s revision petition raised “arguable questions” requiring judicial consideration.

The Second Additional District and Sessions Judge admitted Chakravarthy’s criminal revision petition and ordered an immediate stay on the July 6 order of the magistrate’s court, which had initiated suo motu proceedings against the Indian Police Service officer.

The magistrate had accused Chakravarthy of repeatedly disobeying court orders and failing to execute arrest warrants in Bandipore district. Bandipore does not fall under the jurisdiction of the Srinagar police chief.

After hearing arguments and examining the petition, the sessions court said it was satisfied that the revision petition merited consideration.

“Without expressing any opinion on the controversy, this court is satisfied that the revision raises arguable questions warranting consideration,” the judge said in a two-page order.

The court directed that the magistrate’s order remain stayed pending further proceedings, called for the lower court records, and fixed the next hearing for July 27.

The revision petition challenges the magistrate’s order on multiple grounds, according to the court order.
